How to send a takedown notice

Your notice must be in writing and include:

  1. your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  2. identification of the copyrighted work you believe is infringed (or, for several works, a representative list);
  3. identification of the material you believe is infringing, with enough information for us to find it, such as the page address (URL);
  4. your name, address, telephone number and email address;
  5. a statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

A notice that does not include these elements may not be acted on. Knowingly misrepresenting that material is infringing can make you liable for damages (17 U.S.C. § 512(f)).

If your material was removed: counter-notice

If material you posted was removed because of a notice and you believe that was a mistake or misidentification, you can send our designated agent a counter-notice. It must be in writing and include:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before it was removed;
  3. a statement, under penalty of perjury, that you believe in good faith that the material was removed as a result of mistake or misidentification; and
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which VenuVio may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We send a copy of a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the activity, we restore the material within 10 to 14 business days after we receive the counter-notice.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
